January 1865-End of the War and Discharge

On the morning of December 31, the Thirteenth West Virginia and Thirty-Sixth Ohio went by train from Martinsburg, West Virginia, to Cumberland, Maryland, with Hayes and his staff following that afternoon.213 They made winter quarters there and remained idle. Perhaps they were too idle because on February 21, 1865, with 4,000 troops in the area, General Crook and Brigadier General Benjamin F. Kelley were seized by the enemy from their hotels in town. They were sent as prisoners to Libbey Prison in Richmond, Virginia, but by March 17 had been traded and returned to their commands.214 By April, Hayes was transferred to New Creek and given a new command.215 The Thirteenth Regiment West Virginia Volunteers remained at Cumberland until discharged in June.
